Screengrab: Private Circulation

Has the Shepard Fairey fair use case been decided already? I wasn’t aware this version of the Obama image fell within what the Associated Press could claim as their own “essential images”.  Tip thanks: Private Circulation.

Haha, thanks samthor, I knew Fairey had threatened lawsuits for doing the same thing he does. Oh the irony.

So is it ok for artists to steal imagery and sell artwork but not ok for others. Exactly where do you draw the line? Why the hell couldn’t he just have asked permission to use the photo to begin with. The audacity they have to sue the AP to allow him to pilfer their image archive is absurd.

Artists want to be able to steal imagery and ideas but funny how they don’t like it when it happens to them:

Looks like a photo of some people in front of a giant art piece, so technically the photo could be something they can use. Totally fair under law, a little underhanded otherwise.
